I.-The merchants referred to in article L. 121-1 of the French Commercial Code may provide cash to the Payment Service User as part of a payment transaction for the purchase of goods or services.
II-This service may only be provided at the request of the Payment Service User acting for non-business purposes made immediately prior to the execution of a payment transaction for the purchase of goods or services and in accordance with article L. 112-1 of the French Consumer Code.
Payments by cheque or by means of paper vouchers, special payment instruments within the meaning of article L. 521-3-2 of the present code or special dematerialised payment instruments within the meaning of article L. 525-4 may not give rise to the provision of cash.
III – In order to ensure the quality of cash circulation and limit the risks of money laundering and terrorist financing, a decree shall specify the terms and conditions for the provision of the service referred to in I of this article. It shall determine:
1° The minimum amount of the payment transaction for the purchase of goods or services for which cash is provided;
2° The maximum amount of cash that may be disbursed in this context.
IV – The Banque de France may, in the event of a threat to the quality of banknotes in circulation or an exceptional event that significantly hampers the supply of euro banknotes, and after informing the Minister for the Economy, temporarily authorise a ceiling higher or lower than that mentioned in 2° of III and adjust the list of payment instruments set out in the second paragraph of II. The Minister for the Economy may terminate these temporary arrangements at any time.
