Article L1122-1-4 of the French Public Health Code

In the case of research involving the human person mentioned in 2° of Article L. 1121-1 , the methodological requirements of which are not compatible with obtaining consent under the conditions provided for in the second paragraph of Article L. 1122-1-1, the protocol submitted for the opinion of the relevant personal data protection committee may provide that consent is not sought and that the information provided for in Article L. 1122-1 is collective.

No research mentioned in the first paragraph may be carried out on a person if that person has objected.

En cas de recherches impliquant la personne humaine mentionnées au 2° de l’article L. 1121-1 dont les exigences méthodologiques ne sont pas compatibles avec le recueil du consentement dans les conditions prévues au deuxième alinéa de l’article L. 1122-1-1, le protocole présenté à l’avis du comité de protection des personnes concerné peut prévoir que ce consentement n’est pas recherché et que l’information prévue à l’article L. 1122-1 est collective.

Aucune recherche mentionnée au premier alinéa ne peut être pratiquée sur une personne lorsqu’elle s’y est opposée.
