Article L1123-1-1 of the French Public Health Code

I. – A National Commission for Research Involving the Human Person, responsible for coordinating, harmonising and evaluating the practices of the Committees for the Protection of Individuals, has been set up under the authority of the Minister for Health.

Each year, it submits recommendations to the Minister for Health concerning the consequences, in terms of healthcare organisation, of research whose results are of major interest for public health.

The National Commission and the National Agency for the Safety of Medicines and Health Products are consulted on draft laws and decrees concerning research involving human subjects.

The National Commission acts in consultation with the Committees for the Protection of Individuals.

II. – Any member of the National Commission for Research Involving the Human Person who takes part in the work or deliberations of the National Commission when he or she has a direct or indirect interest in the matter being examined is liable to five years’ imprisonment and a fine of €75,000.

Members of the National Commission for Research Involving the Human Person are required to draw up and update a declaration of interests under the conditions set out in article L. 1451-1. The fact of knowingly failing to draw up such a declaration, to amend it in order to update the data contained therein or to provide misleading information that undermines the sincerity of the said declaration is punishable by a fine of €30,000.

For the offences referred to in this II, persons are also liable to the additional penalties provided for in Article L. 1454-4.

III. – The procedures for applying this article and the composition of the national commission are set by decree.

Article L1123-1-1

I. – Il est institué auprès du ministre chargé de la santé une commission nationale des recherches impliquant la personne humaine, chargée de la coordination, de l’harmonisation et de l’évaluation des pratiques des comités de protection des personnes.

Elle remet chaque année au ministre chargé de la santé des recommandations concernant les conséquences, en matière d’organisation des soins, des recherches dont les résultats présentent un intérêt majeur pour la santé publique.

La commission nationale et l’Agence nationale de sécurité du médicament et des produits de santé sont consultées sur les projets de loi ou de décret concernant les recherches impliquant la personne humaine.

La commission nationale agit en concertation avec les comités de protection des personnes.

II. – Le fait pour un membre de la Commission nationale des recherches impliquant la personne humaine de prendre part aux travaux ou aux délibérations de la commission nationale alors qu’il a un intérêt, direct ou indirect, à l’affaire examinée est puni de cinq ans d’emprisonnement et de 75 000 € d’amende.

Les membres de la Commission nationale des recherches impliquant la personne humaine sont tenus d’établir et d’actualiser une déclaration d’intérêts dans les conditions fixées à l’article L. 1451-1. Le fait pour eux d’omettre sciemment d’établir une telle déclaration, de la modifier afin d’actualiser les données qui y figurent ou de fournir une information mensongère qui porte atteinte à la sincérité de ladite déclaration est puni de 30 000 € d’amende.

Pour les infractions mentionnées au présent II, les personnes encourent également les peines complémentaires prévues à l’article L. 1454-4.

III. – Les modalités d’application du présent article ainsi que la composition de la commission nationale sont fixées par décret.
