Article L1128-3 of the French Public Health Code

Carrying out or causing to be carried out research involving the human person in breach of the provisions of Articles L. 1121-5 to L. 1121-8 and Article L. 1122-1-2 and in breach of Articles 31 to 34 of Regulation (EU) No 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products is punishable by three years’ imprisonment and a fine of €45,000.

Natural persons guilty of the offence provided for in the previous paragraph shall also incur the following penalties:

1° Disqualification from civic, civil and family rights, in accordance with the provisions of article 131-26 of the Criminal Code ;

2° Prohibition, for a maximum of five years, from engaging in the professional or social activity in the course of which or in the exercise of which the offence was committed;

3° Confiscation as defined in article 131-21 of the Criminal Code;

4° permanent exclusion from public contracts or exclusion from public contracts for a maximum of five years.

Article L1128-3

Le fait de pratiquer ou de faire pratiquer une recherche impliquant la personne humaine en infraction aux dispositions des articles L. 1121-5 à L. 1121-8 et de l’article L. 1122-1-2 et en infraction avec les articles 31 à 34 du règlement (UE) n° 536/2014 du Parlement européen et du Conseil du 16 avril 2014 relatif aux essais cliniques de médicaments est puni de trois ans d’emprisonnement et de 45 000 euros d’amende.

Les personnes physiques coupables de l’infraction prévue à l’alinéa précédent encourent également les peines suivantes :

1° L’interdiction des droits civiques, civils et de famille, suivant les modalités prévues par l’article 131-26 du code pénal ;

2° L’interdiction, pour une durée de cinq ans au plus, d’exercer l’activité professionnelle ou sociale à l’occasion de laquelle ou dans l’exercice de laquelle l’infraction a été commise ;

3° La confiscation définie à l’article 131-21 du code pénal ;

4° L’exclusion des marchés publics à titre définitif ou pour une durée de cinq ans au plus.
