Carrying out or causing to be carried out research involving the human person in breach of the provisions of Articles L. 1121-5 to L. 1121-8 and Article L. 1122-1-2 and in breach of Articles 31 to 34 of Regulation (EU) No 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products is punishable by three years’ imprisonment and a fine of €45,000.
Natural persons guilty of the offence provided for in the previous paragraph shall also incur the following penalties:
1° Disqualification from civic, civil and family rights, in accordance with the provisions of article 131-26 of the Criminal Code ;
2° Prohibition, for a maximum of five years, from engaging in the professional or social activity in the course of which or in the exercise of which the offence was committed;
3° Confiscation as defined in article 131-21 of the Criminal Code;
4° permanent exclusion from public contracts or exclusion from public contracts for a maximum of five years.
