As stated in Article 226-28 of the Criminal Code, reproduced below:
“The fact of seeking to identify a person by his or her genetic fingerprints outside the cases provided for in Article 16-11 of the Civil Code or outside a measure of investigation or enquiry carried out during a procedure to verify a civil status record undertaken by diplomatic or consular authorities under the provisions of Article L. 111-6 of the Code on the Entry and Residence of Foreigners and the Right of Asylum is punishable by one year’s imprisonment or a fine of €15,000.
The same penalties shall apply to the disclosure of information relating to the identification of a person by their genetic fingerprints or to the examination of a person’s genetic characteristics or the identification of a person by their genetic fingerprints without holding the authorisation provided for in Article L. 1131-3 of the Public Health Code and the authorisation provided for in Article L. 1131-2-1 of the same Code. “
