Article L1142-26 of the French Public Health Code

Legal entities found to be criminally liable, under the conditions set out in article 121-2 of the French Penal Code, for the offence defined in article L. 1142-25 shall incur, in addition to the fine set out in article 131-38 of the French Penal Code, the penalty set out in 2° of article 131-39 of the same code. The ban imposed in this respect shall apply to the activity in the exercise or on the occasion of which the offence was committed. This ban is brought to the attention of the Director General of the Regional Health Agency, who informs the health insurance organisations.

Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, de l’infraction définie à l’article L. 1142-25 encourent, outre l’amende suivant les modalités prévues par l’article 131-38 du code pénal, la peine prévue par le 2° de l’article 131-39 du même code.L’interdiction prononcée à ce titre porte sur l’activité dans l’exercice ou à l’occasion de laquelle l’infraction a été commise. Cette interdiction est portée à la connaissance du directeur général de l’agence régionale de santé, qui en informe les organismes d’assurance maladie.
