Article L1142-3 of the French Public Health Code

The provisions of this section do not apply to the sponsor of research involving the human person, who may be held liable in accordance with the first paragraph of article L. 1121-10 and who is subject to the insurance obligation provided for in the third paragraph of the same article.

Persons who suffer damage in the context of research involving the human person may assert their rights in application of the first two paragraphs of article L. 1121-10 with the regional commissions mentioned in sections 2, 3 and 4 of this chapter. Where the sponsor is not liable, the victims may be compensated by the office instituted by article L. 1142-22, in accordance with the provisions of II of article L. 1142-1. However, compensation in this case is not subject to the requirement of seriousness set out in these provisions.

Les dispositions de la présente section ne sont pas applicables au promoteur de recherche impliquant la personne humaine, dont la responsabilité peut être engagée conformément au premier alinéa de l’article L. 1121-10 et qui est soumis à l’obligation d’assurance prévue au troisième alinéa du même article.

Les personnes qui subissent des dommages dans le cadre de la recherche impliquant la personne humaine peuvent faire valoir leurs droits en application des deux premiers alinéas de l’article L. 1121-10 auprès des commissions régionales mentionnées aux sections 2,3 et 4 du présent chapitre. Lorsque la responsabilité du promoteur n’est pas engagée, les victimes peuvent être indemnisées par l’office institué à l’article L. 1142-22, conformément aux dispositions du II de l’article L. 1142-1. Toutefois l’indemnisation n’est pas dans ce cas subordonnée au caractère de gravité prévu par ces dispositions.
