Article L1142-4 of the French Public Health Code

Any person who has suffered harm or who considers him/herself to have suffered harm as a result of a preventive, diagnostic or healthcare activity, or his/her heirs if the person has died, or, where appropriate, his/her legal representative if the person is a minor, must be informed by the professional, health establishment, health services or body concerned of the circumstances and causes of the harm. If the victim is a protected adult, the person in charge of the protective measure must also be informed.

This information is given to the person no later than fifteen days after the damage is discovered or at their express request, during an interview in which the person may be assisted by a doctor or another person of their choice.

Toute personne victime ou s’estimant victime d’un dommage imputable à une activité de prévention, de diagnostic ou de soins ou ses ayants droit, si la personne est décédée, ou, le cas échéant, son représentant légal s’il s’agit d’un mineur, doit être informée par le professionnel, l’établissement de santé, les services de santé ou l’organisme concerné sur les circonstances et les causes de ce dommage. Si la victime est un majeur protégé, la personne chargée de la mesure de protection doit également être informée.

Cette information lui est délivrée au plus tard dans les quinze jours suivant la découverte du dommage ou sa demande expresse, lors d’un entretien au cours duquel la personne peut se faire assister par un médecin ou une autre personne de son choix.
