The Regional Commissions for Conciliation and Compensation of Medical Accidents, Iatrogenic Diseases and Nosocomial Infections are chaired by a magistrate from the administrative order or a magistrate from the judicial order, in active service or honorary. In particular, they include representatives of patients and users of the healthcare system, healthcare professionals and managers of healthcare establishments and services, as well as members representing the office instituted in article L. 1142-22 and insurance companies.
The composition of the regional commissions and their operating rules, designed to guarantee their independence and impartiality, as well as the procedure followed before these commissions, are determined by decree in the Conseil d’Etat.
The operating costs of the commissions are covered by the office set up under article L. 1142-22. The Office also provides them with technical and administrative support, in particular by making the necessary staff available to them.
Members of the commissions and persons who have access to documents and information held by them are bound by professional secrecy, under the conditions and subject to the penalties laid down in articles 226-13 and 226-14 of the French Penal Code.
