Article L1142-9-1 of the French Labour Code

When the results obtained by the company with regard to the indicators mentioned in article L. 1142-8 are below a level defined by decree, the employer sets and publishes the targets for progress for each of these indicators, in accordance with the procedures laid down in articles L. 2242-1 and L. 2242-3 and under conditions defined by the same decree.

Lorsque les résultats obtenus par l’entreprise au regard des indicateurs mentionnés à l’article L. 1142-8 se situent en deçà d’un niveau défini par décret, l’employeur fixe et publie les objectifs de progression de chacun de ces indicateurs, selon les modalités prévues aux articles L. 2242-1 et L. 2242-3 et dans des conditions définies par le même décret.
