The out-of-court compensation agreement is proposed to the parties by the mediator.

It must be accepted by the claimant association and at least one of the defendants in the action brought under article L. 1143-2 and approved by the court hearing the action.

La convention d’indemnisation amiable est proposée aux parties par le médiateur.

Elle doit être acceptée par l’association requérante et l’une au moins des personnes mises en cause dans l’action engagée en application de l’article L. 1143-2 et être homologuée par le juge saisi de cette action.
