Article L1144-2 of the French Labour Code

The representative trade union organisations at national level or in the company may take any legal action resulting from the application of articles L. 3221-2 to L. 3221-7, relating to equal pay for men and women.

They may take such action on behalf of a job applicant, a trainee or an employee.

The trade union organisation does not have to prove that it has a mandate from the person concerned. All that is required is that the person concerned has been notified in writing of the action and has not objected within a period of fifteen days from the date on which the trade union organisation notified him of its intention to take action.

The person concerned may always intervene in the proceedings brought by the union.

Les organisations syndicales représentatives au niveau national ou dans l’entreprise peuvent exercer en justice toutes actions résultant de l’application des articles L. 3221-2 à L. 3221-7, relatifs à l’égalité de rémunération entre les femmes et les hommes.

Elles peuvent exercer ces actions en faveur d’un candidat à un emploi, à un stage ou à une période de formation ou d’un salarié.

L’organisation syndicale n’a pas à justifier d’un mandat de l’intéressé. Il suffit que celui-ci ait été averti par écrit de cette action et ne s’y soit pas opposé dans un délai de quinze jours à compter de la date à laquelle l’organisation syndicale lui a notifié son intention d’agir.

L’intéressé peut toujours intervenir à l’instance engagée par le syndicat.
