Article L1211-3 of the French Public Health Code

Advertising in favour of a donation of human body parts or products for the benefit of a specific person or for the benefit of a specific establishment or body is prohibited. This prohibition does not prevent the provision of information to the public in favour of the donation of human body parts and products.

This information is provided under the responsibility of the Minister for Health, in collaboration with the Minister for National Education.

Doctors shall ensure that their patients who are at least sixteen years old are informed of the procedures for consenting to organ donation for transplantation purposes and, failing this, shall provide them with this information individually as soon as possible.

La publicité en faveur d’un don d’éléments ou de produits du corps humain au profit d’une personne déterminée ou au profit d’un établissement ou organisme déterminé est interdite. Cette interdiction ne fait pas obstacle à l’information du public en faveur du don d’éléments et produits du corps humain.

Cette information est réalisée sous la responsabilité du ministre chargé de la santé, en collaboration avec le ministre chargé de l’éducation nationale.

Les médecins s’assurent que leurs patients âgés d’au moins seize ans sont informés des modalités de consentement au don d’organes à fins de greffe et, à défaut, leur délivrent individuellement cette information dès que possible.
