The sample may only be taken with the donor’s consent by a doctor or under his direction and responsibility.

By way of derogation from the first paragraph, a decree of the Conseil d’Etat lays down the conditions under which medical students who have completed the second year of the second cycle of medical studies may take such a sample.

No remuneration may be paid to the donor, without prejudice to the reimbursement of expenses incurred, under conditions laid down by decree.

Le prélèvement ne peut être fait qu’avec le consentement du donneur par un médecin ou sous sa direction et sa responsabilité.

Par dérogation au premier alinéa, un décret en Conseil d’Etat prévoit les conditions dans lesquelles les étudiants en médecine ayant validé la deuxième année du deuxième cycle des études médicales peuvent effectuer un tel prélèvement.

Aucune rémunération ne peut être allouée au donneur, sans préjudice du remboursement des frais exposés, dans des conditions fixées par décret.
