I.-Subject to the provisions of article L. 5124-14, the Etablissement français du sang is responsible for developing all activities relating to blood transfusion, advice and monitoring transfusion procedures. As such, it may be authorised to manufacture, import and use blood-derived medicinal products as defined in b of 18° of article L. 5121-1.
These activities are carried out under the responsibility of a responsible pharmacist participating in the general management of the establishment and subject to the provisions of this chapter.
For the performance of these activities, the Etablissement Français du Sang is subject to articles L. 5124-2, with the exception of its first paragraph, L. 5124-3, L. 5124-4, with the exception of its last paragraph, L. 5124-5, L. 5124-6, L. 5124-11 and L. 5124-18.
II -The Etablissement Français du Sang may also, on an ancillary basis, be authorised to carry out other healthcare activities, in particular the activities provided for in articles L. 1243-2 and L. 5124-9-1 and healthcare and medical biology laboratory activities, in accordance with the rules applicable to these activities.
III – By way of derogation from Article L. 6222-5, the Etablissement français du sang which, as part of the medical biology laboratory activities provided for in this Article, carries out “recipient” immuno-haematology tests and complex immuno-haematology tests may have laboratories with several sites located in more than three areas mentioned in b of 2° of Article L. 1434-9, in the geographical areas of activity determined in application of the national master plan mentioned in Article L. 1222-11.
The second paragraph of I of Article L. 6211-19 does not apply to the transmission of biological samples by the medical biology laboratories of health establishments to the Etablissement français du sang for the immuno-haematology examinations mentioned in the previous paragraph.
The Etablissement Français du Sang is authorised to procure, store, dispense and administer the medicinal products necessary to carry out its blood transfusion activities and, where applicable, its healthcare activities.
