Article L1222-10 of the French Labour Code

In addition to his obligations under ordinary law towards his employees, the employer is obliged with regard to the teleworking employee:

1° Inform the employee of any restrictions on the use of computer equipment or tools or electronic communication services and of the penalties for failure to comply with such restrictions;

2° To give the employee priority to occupying or returning to a non-teleworking position that corresponds to his or her professional qualifications and skills, and to inform the employee of the availability of any such position;

3° to organise an annual interview which will focus in particular on the employee’s working conditions and workload.

Outre ses obligations de droit commun vis-à-vis de ses salariés, l’employeur est tenu à l’égard du salarié en télétravail :

1° D’informer le salarié de toute restriction à l’usage d’équipements ou outils informatiques ou de services de communication électronique et des sanctions en cas de non-respect de telles restrictions ;

2° De lui donner priorité pour occuper ou reprendre un poste sans télétravail qui correspond à ses qualifications et compétences professionnelles et de porter à sa connaissance la disponibilité de tout poste de cette nature ;

3° D’organiser chaque année un entretien qui porte notamment sur les conditions d’activité du salarié et sa charge de travail.
