Article L1222-5 of the French Labour Code

The employer may not impose any exclusivity clause for a period of one year on an employee who sets up or takes over a business, even if there is a contractual stipulation or agreement to the contrary. However, this prohibition does not apply to the exclusivity clause provided for by article L. 7313-6 for travellers, representatives or salespersons.

When leave to create or take over a business is extended under the conditions provided for in Articles L. 3142-111, L. 3142-117 and L. 3142-119, the provisions of the first paragraph apply until the end of the extension.

The employee remains subject to the obligation of loyalty towards his employer.

L’employeur ne peut opposer aucune clause d’exclusivité pendant une durée d’un an au salarié qui crée ou reprend une entreprise, même en présence de stipulation contractuelle ou conventionnelle contraire. Toutefois, cette interdiction ne s’applique pas à la clause d’exclusivité prévue par l’article L. 7313-6 pour les voyageurs, représentants ou placiers.

Lorsqu’un congé pour la création ou la reprise d’entreprise est prolongé dans les conditions prévues aux articles L. 3142-111, L. 3142-117 et L. 3142-119, les dispositions du premier alinéa s’appliquent jusqu’au terme de la prolongation.

Le salarié reste soumis à l’obligation de loyauté à l’égard de son employeur.
