Article L1225-10 of the French Labour Code

If the employer is unable to offer another job to the employee working at night, it shall inform her in writing, and the occupational physician, of the reasons for not doing so.

The employee’s employment contract is then suspended until the date of commencement of the statutory maternity leave and possibly during the additional period following the end of this leave in application of article L. 1225-9.

The employee benefits from a guaranteed remuneration during the suspension of the employment contract, consisting of the daily allowance provided for in article L. 333-1 of the Social Security Code and a supplementary allowance payable by the employer, calculated according to the same terms and conditions as those provided for in article L. 1226-1, with the exception of the provisions relating to seniority.

Lorsque l’employeur est dans l’impossibilité de proposer un autre emploi à la salariée travaillant de nuit, il lui fait connaître par écrit, ainsi qu’au médecin du travail, les motifs qui s’opposent à cette affectation.

Le contrat de travail de la salariée est alors suspendu jusqu’à la date du début du congé légal de maternité et éventuellement durant la période complémentaire qui suit la fin de ce congé en application de l’article L. 1225-9.

La salariée bénéficie d’une garantie de rémunération pendant la suspension du contrat de travail, composée de l’allocation journalière prévue à l’article L. 333-1 du code de la sécurité sociale et d’une indemnité complémentaire à la charge de l’employeur, calculée selon les mêmes modalités que celles prévues à l’article L. 1226-1, à l’exception des dispositions relatives à l’ancienneté.
