Article L1226-11 of the French Labour Code

If, at the end of a period of one month from the date of the medical examination to resume work, the employee declared unfit has not been reclassified within the company or if he has not been dismissed, the employer will pay him, from the expiry of this period, the salary corresponding to the job he held before the suspension of his employment contract.

These provisions also apply in the event of unfitness for any job in the company, as determined by the company doctor.

Lorsque, à l’issue d’un délai d’un mois à compter de la date de l’examen médical de reprise du travail, le salarié déclaré inapte n’est pas reclassé dans l’entreprise ou s’il n’est pas licencié, l’employeur lui verse, dès l’expiration de ce délai, le salaire correspondant à l’emploi que celui-ci occupait avant la suspension de son contrat de travail.

Ces dispositions s’appliquent également en cas d’inaptitude à tout emploi dans l’entreprise constatée par le médecin du travail.
