Article L1226-16 of the French Labour Code

The indemnities provided for in articles L. 1226-14 and L. 1226-15 are calculated on the basis of the average salary that the person concerned would have received over the last three months if he had continued to work in the position he held prior to the suspension of the employment contract caused by the accident at work or occupational disease.

For the purposes of calculating these allowances, the notion of salary is defined as the personal rate, bonuses, benefits of any kind, allowances and gratuities that make up the income.

Les indemnités prévues aux articles L. 1226-14 et L. 1226-15 sont calculées sur la base du salaire moyen qui aurait été perçu par l’intéressé au cours des trois derniers mois s’il avait continué à travailler au poste qu’il occupait avant la suspension du contrat de travail provoquée par l’accident du travail ou la maladie professionnelle.

Pour le calcul de ces indemnités, la notion de salaire est définie par le taux personnel, les primes, les avantages de toute nature, les indemnités et les gratifications qui composent le revenu.
