Where an act, agreement or judgment does not meet the conditions for registration under the provisions of articles L. 123-1 or L. 123-2, it may however be published in the public film and audiovisual register or in the register of options at the request of its beneficiary if it has the effect of transferring or establishing the transfer to the latter of one of the rights mentioned in these articles and if the transferred right results from a deed, agreement or judgement that has been the subject of a previous registration that the applicant designates. The applicant may request that only those particulars of the deed, agreement or judgment that effect or record the transfer be published. However, unilateral declarations relating to resolutory clauses in registered agreements may not be published. Acts, agreements or judgements published in the public film and audiovisual register or in the register of options may be relied upon by third parties.
Publication in the register of options of a deed, agreement or judgment is carried over to the public film and audiovisual register when the producer, after exercising the option, files the title of the cinematographic or audiovisual work under the conditions provided for in Article L. 122-1.
