The removal of organs from a person whose death has been duly confirmed may only be carried out for therapeutic or scientific purposes.
The doctor shall inform the deceased’s next of kin, prior to the planned removal, of its nature and purpose, in accordance with the best practices laid down by the Minister for Health on a proposal from the Biomedicine Agency.
The sample may be taken from a person who has reached the age of majority, provided that he or she has not, during his or her lifetime, made known his or her refusal to have the sample taken, primarily by entering his or her name in an automated national register set up for this purpose. This refusal may be revoked at any time.
The Agence de la biomédecine is notified prior to any removal for therapeutic or scientific purposes.
