Article L1233-23 of the French Labour Code

The agreement provided for in Article L. 1233-21 may not derogate from :

1° from the general rules of information and consultation of the social and economic committee provided for in articles L. 2323-2, L. 2323-4 and L. 2323-5 ;

2° The provision to staff representatives of the information provided for in articles L. 1233-31 to L. 1233-33;

3° The consultation rules applicable in the event of receivership or compulsory liquidation, as provided for in article L. 1233-58.

Article L1233-23

L’accord prévu à l’article L. 1233-21 ne peut déroger :

1° Aux règles générales d’information et de consultation du comité social et économique prévues aux articles L. 2323-2, L. 2323-4 et L. 2323-5 ;

2° A la communication aux représentants du personnel des renseignements prévus aux articles L. 1233-31 à L. 1233-33 ;

3° Aux règles de consultation applicables lors d’un redressement ou d’une liquidation judiciaire, prévues à l’article L. 1233-58.
