In companies with at least fifty employees, where the redundancy project concerns at least ten employees within the same thirty-day period, the Social and Economic Committee may, where appropriate on the recommendation of the committees set up within it, decide, at the first meeting provided for inArticle L. 1233-30, to call in an expert report which may cover the economic and accounting fields as well as health, safety or the potential effects of the project on working conditions.
The terms and conditions for carrying out the expert appraisal, when it relates to one or more of the areas referred to in the first paragraph, are determined by a decree of the Conseil d’Etat.
The expert may be assisted under the conditions set out inArticle L. 2315-81.
The Social and Economic Committee may also appoint an expert to provide any analysis that may be useful to the trade union organisations in conducting the negotiations provided for inarticle L. 1233-24-1.
The expert’s report is submitted to the Social and Economic Committee and, where applicable, to the trade union organisations, no later than fifteen days before the expiry of the period mentioned in article L. 1233-30.
