Article L1233-4 of the French Labour Code

An employee may only be made redundant for economic reasons when all efforts to train and adapt have been made and when the person concerned cannot be redeployed to available jobs located in France in the undertaking or other undertakings in the group to which the undertaking belongs and whose organisation, activities or place of operation ensure the transfer of all or part of the staff.

For the application of this article, the notion of group refers to the group formed by a company called the dominant company and the companies it controls under the conditions defined inarticle L. 233-1, I and II of article L. 233-3 andarticle L. 233-16 of the French Commercial Code.

The employee is reassigned to a job in the same category as the one he/she occupies or to an equivalent job with equivalent remuneration. Failing this, and subject to the employee’s express agreement, the employee will be reassigned to a job in a lower category.

The employer will make personalised offers of redeployment to each employee or distribute a list of available positions to all employees by any means, under conditions specified by decree.

Outplacement offers made to employees must be in writing and precise.

Le licenciement pour motif économique d’un salarié ne peut intervenir que lorsque tous les efforts de formation et d’adaptation ont été réalisés et que le reclassement de l’intéressé ne peut être opéré sur les emplois disponibles, situés sur le territoire national dans l’entreprise ou les autres entreprises du groupe dont l’entreprise fait partie et dont l’organisation, les activités ou le lieu d’exploitation assurent la permutation de tout ou partie du personnel.

Pour l’application du présent article, la notion de groupe désigne le groupe formé par une entreprise appelée entreprise dominante et les entreprises qu’elle contrôle dans les conditions définies à l’article L. 233-1, aux I et II de l’article L. 233-3 et à l’article L. 233-16 du code de commerce.

Le reclassement du salarié s’effectue sur un emploi relevant de la même catégorie que celui qu’il occupe ou sur un emploi équivalent assorti d’une rémunération équivalente. A défaut, et sous réserve de l’accord exprès du salarié, le reclassement s’effectue sur un emploi d’une catégorie inférieure.

L’employeur adresse de manière personnalisée les offres de reclassement à chaque salarié ou diffuse par tout moyen une liste des postes disponibles à l’ensemble des salariés, dans des conditions précisées par décret.

Les offres de reclassement proposées au salarié sont écrites et précises.
