The employer consults the social and economic committee on any takeover offer that it wishes to take up and indicates the reasons for accepting the offer, particularly with regard to the offeror’s ability to guarantee the continuity of the business and employment in the establishment. The Social and Economic Committee issues an opinion on this offer within a timeframe set in application of article L. 2323-3.
When the procedure is adapted in application of article L. 1233-24-2 to favour a project for the transfer of one or more economic entities mentioned in article L. 1233-61, the employer consults the social and economic committee on the takeover offer within the timeframe set by the collective agreement mentioned in article L. 1233-24-2.
