Article L1233-60-1 of the French Labour Code

In the event of receivership or compulsory liquidation, where the employer is considering modifying an essential element of the employment contract for one of the economic reasons set out in article L. 1233-3, he shall make the proposal to the employee by registered letter with acknowledgement of receipt.

The letter of notification informs the employee that he has a period of fifteen days from receipt to make known his refusal.

If no reply is received within this period, the employee is deemed to have accepted the proposed change.

En cas de redressement judiciaire ou de liquidation judiciaire, lorsque l’employeur envisage la modification d’un élément essentiel du contrat de travail pour l’un des motifs économiques énoncés à l’article L. 1233-3, il en fait la proposition au salarié par lettre recommandée avec avis de réception.

La lettre de notification informe le salarié qu’il dispose d’un délai de quinze jours à compter de sa réception pour faire connaître son refus.

A défaut de réponse dans ce délai, le salarié est réputé avoir accepté la modification proposée.
