Organs removed during surgery, carried out in the interests of the person operated on, may be used for therapeutic or scientific purposes, unless that person objects after being informed of the purpose of the use.

Where this person is a minor or an adult subject to a legal protection measure with representation of the person, the subsequent use of the organs thus removed is also subject to the absence of opposition from the persons invested with parental authority or the person in charge of the protection measure, who have been duly informed of the purpose of this use. The refusal of the minor or protected adult shall constitute an obstacle to such use.

Organs removed in this way are subject to the provisions of Title I, with the exception of the first paragraph of article L. 1211-2, and to those of Chapters III and IV of this Title.

Les organes prélevés à l’occasion d’une intervention chirurgicale, pratiquée dans l’intérêt de la personne opérée, peuvent être utilisés à des fins thérapeutiques ou scientifiques, sauf opposition exprimée par elle après qu’elle a été informée de l’objet de cette utilisation.

Lorsque cette personne est un mineur ou un majeur faisant l’objet d’une mesure de protection juridique avec représentation à la personne, l’utilisation ultérieure des organes ainsi prélevés est en outre subordonnée à l’absence d’opposition des personnes investies de l’exercice de l’autorité parentale ou de la personne chargée de la mesure de protection, dûment informées de l’objet de cette utilisation. Le refus du mineur ou du majeur protégé fait obstacle à cette utilisation.

Les organes ainsi prélevés sont soumis aux dispositions du titre Ier, à l’exception du premier alinéa de l’article L. 1211-2, et à celles des chapitres III et IV du présent titre.
