Article L1237-1 of the French Labour Code

In the event of resignation, the existence and duration of the notice period are determined by law or by collective labour agreement.

In the absence of legal provisions, collective labour agreement or convention relating to notice, its existence and duration are determined by local and professional practice.

A decree of the Conseil d’Etat shall determine the terms and conditions of application of this article.

En cas de démission, l’existence et la durée du préavis sont fixées par la loi, ou par convention ou accord collectif de travail.

En l’absence de dispositions légales, de convention ou accord collectif de travail relatifs au préavis, son existence et sa durée résultent des usages pratiqués dans la localité et dans la profession.

Un décret en Conseil d’Etat détermine les modalités d’application du présent article.
