Article L1237-14 of the French Labour Code

At the end of the cooling-off period, the earliest party shall send a request for approval to the administrative authority, together with a copy of the termination agreement. An order of the Minister for Employment sets the model for this application.

The administrative authority has a period of fifteen working days from receipt of the request to ensure that the conditions set out in this section are met and that the parties are free to consent. If no notification is received within this period, the agreement is deemed to have been approved and the administrative authority is relieved of its responsibility.

The validity of the agreement is subject to its homologation.

The homologation may not be the subject of a dispute separate from that relating to the agreement. Any dispute concerning the agreement, its approval or the refusal to approve it falls within the jurisdiction of the industrial tribunal (Conseil des prud’hommes), to the exclusion of any other contentious or administrative appeal. Any legal action must be filed, failing which it will be inadmissible, before the expiry of a period of twelve months from the date of approval of the agreement.

A l’issue du délai de rétractation, la partie la plus diligente adresse une demande d’homologation à l’autorité administrative, avec un exemplaire de la convention de rupture. Un arrêté du ministre chargé du travail fixe le modèle de cette demande.

L’autorité administrative dispose d’un délai d’instruction de quinze jours ouvrables, à compter de la réception de la demande, pour s’assurer du respect des conditions prévues à la présente section et de la liberté de consentement des parties.A défaut de notification dans ce délai, l’homologation est réputée acquise et l’autorité administrative est dessaisie.

La validité de la convention est subordonnée à son homologation.

L’homologation ne peut faire l’objet d’un litige distinct de celui relatif à la convention. Tout litige concernant la convention, l’homologation ou le refus d’homologation relève de la compétence du conseil des prud’hommes, à l’exclusion de tout autre recours contentieux ou administratif. Le recours juridictionnel doit être formé, à peine d’irrecevabilité, avant l’expiration d’un délai de douze mois à compter de la date d’homologation de la convention.
