Article L1237-18-2 of the French Labour Code

The collective agreement determines :

1° The duration of the mobility leave ;

2° The conditions that the employee must meet in order to benefit from it;

3° The terms and conditions for the employee’s acceptance of the employer’s proposal, including the conditions for expressing his written consent, and the commitments of the parties;

4° The organisation of the work periods, the conditions under which the leave is terminated and the arrangements for supporting the planned training activities;

5° The level of remuneration paid during the period of mobility leave;

6° The conditions for informing staff representative bodies;

7° The severance payments guaranteed to the employee, which may not be less than the statutory payments due in the event of redundancy for economic reasons.

L’accord collectif détermine :

1° La durée du congé de mobilité ;

2° Les conditions que doit remplir le salarié pour en bénéficier ;

3° Les modalités d’adhésion du salarié à la proposition de l’employeur, comprenant les conditions d’expression de son consentement écrit, et les engagements des parties ;

4° L’organisation des périodes de travail, les conditions auxquelles il est mis fin au congé et les modalités d’accompagnement des actions de formation envisagées ;

5° Le niveau de la rémunération versée pendant la période du congé de mobilité ;

6° Les conditions d’information des institutions représentatives du personnel ;

7° Les indemnités de rupture garanties au salarié, qui ne peuvent être inférieures aux indemnités légales dues en cas de licenciement pour motif économique.
