The employer’s acceptance of the employee’s application under the collective agreement terminates the employment contract by mutual agreement of the parties, where applicable under the conditions provided for in article L. 1237-18-4.
Employees benefiting from the protection mentioned in Chapter I of Title I of Book IV of Part Two may benefit from the provisions of the agreement on collective redundancy. By way of derogation from the first paragraph of this article, termination by mutual agreement within the framework of the collective agreement is subject to authorisation by the Labour Inspector under the conditions set out in Chapter I of Title II of Book IV of Part Two. In this case, the employment contract may only be terminated on the day following the date of authorisation.
In the case of company doctors, termination of the contract is subject to authorisation by the Labour Inspector, after obtaining the opinion of the company doctor inspector.
