Article L1237-19-2 of the French Labour Code

The employer’s acceptance of the employee’s application under the collective agreement terminates the employment contract by mutual agreement of the parties, where applicable under the conditions provided for in article L. 1237-18-4.

Employees benefiting from the protection mentioned in Chapter I of Title I of Book IV of Part Two may benefit from the provisions of the agreement on collective redundancy. By way of derogation from the first paragraph of this article, termination by mutual agreement within the framework of the collective agreement is subject to authorisation by the Labour Inspector under the conditions set out in Chapter I of Title II of Book IV of Part Two. In this case, the employment contract may only be terminated on the day following the date of authorisation.

In the case of company doctors, termination of the contract is subject to authorisation by the Labour Inspector, after obtaining the opinion of the company doctor inspector.

L’acceptation par l’employeur de la candidature du salarié dans le cadre de la rupture conventionnelle collective emporte rupture du contrat de travail d’un commun accord des parties, le cas échéant dans les conditions prévues à l’article L. 1237-18-4.

Les salariés bénéficiant d’une protection mentionnée au chapitre Ier du titre Ier du livre IV de la deuxième partie peuvent bénéficier des dispositions de l’accord portant rupture conventionnelle collective. Par dérogation au premier alinéa du présent article, la rupture d’un commun accord dans le cadre de la rupture conventionnelle collective est soumise à l’autorisation de l’inspecteur du travail dans les conditions prévues au chapitre Ier du titre II du livre IV de la deuxième partie. Dans ce cas la rupture du contrat de travail ne peut intervenir que le lendemain du jour de l’autorisation.

Pour les médecins du travail, la rupture du contrat est soumise à l’autorisation de l’inspecteur du travail, après avis du médecin inspecteur du travail.
