Article L1251-13 of the French Labour Code

When the engagement contract is concluded to replace an employee who is temporarily absent or whose employment contract has been suspended, or for a replacement carried out under 4° and 5° of Article L. 1251-6, it may take effect before the absence of the person to be replaced.

Lorsque le contrat de mission est conclu pour remplacer un salarié temporairement absent ou dont le contrat de travail est suspendu ou pour un remplacement effectué au titre des 4° et 5° de l’article L. 1251-6, il peut prendre effet avant l’absence de la personne à remplacer.
