Article L1251-16 of the French Labour Code

The assignment contract is drawn up in writing.

It shall include in particular:

1° A reproduction of the clauses and information in the secondment contract listed in article L. 1251-43 ;

2° The employee’s professional qualifications;

3° The terms and conditions of the remuneration due to the employee, including the end-of-assignment allowance provided for in article L. 1251-32;

4° The length of any trial period;

5° A clause covering the repatriation of the employee at the expense of the temporary employment contractor when the assignment takes place outside mainland France. This clause becomes null and void if the contract is terminated at the employee’s initiative;

6° The name and address of the supplementary pension fund and provident fund to which the temporary work agency is affiliated;

7° A statement that the user company is not prohibited from hiring the employee at the end of the assignment.

Article L1251-16

Le contrat de mission est établi par écrit.

Il comporte notamment :

1° La reproduction des clauses et mentions du contrat de mise à disposition énumérées à l’article L. 1251-43 ;

2° La qualification professionnelle du salarié ;

3° Les modalités de la rémunération due au salarié, y compris celles de l’indemnité de fin de mission prévue à l’article L. 1251-32 ;

4° La durée de la période d’essai éventuellement prévue ;

5° Une clause de rapatriement du salarié à la charge de l’entrepreneur de travail temporaire lorsque la mission s’effectue hors du territoire métropolitain. Cette clause devient caduque en cas de rupture du contrat à l’initiative du salarié ;

6° Le nom et l’adresse de la caisse de retraite complémentaire et de l’organisme de prévoyance dont relève l’entreprise de travail temporaire ;

7° La mention selon laquelle l’embauche du salarié par l’entreprise utilisatrice à l’issue de la mission n’est pas interdite.
