Article L1251-49 of the French Labour Code

The temporary employment contractor must at all times provide evidence of a financial guarantee ensuring payment in the event of default by the contractor:

1° Wages and related benefits ;

2° Compensation under this chapter;

3° Compulsory contributions due to social security bodies or social institutions;

4° Reimbursements which may, where applicable, be the responsibility of employers in respect of social security bodies and social institutions under the conditions set out in Article L. 244-8 of the Social Security Code.

L’entrepreneur de travail temporaire justifie, à tout moment, d’une garantie financière assurant, en cas de défaillance de sa part, le paiement :

1° Des salaires et de leurs accessoires ;

2° Des indemnités résultant du présent chapitre ;

3° Des cotisations obligatoires dues à des organismes de sécurité sociale ou à des institutions sociales ;

4° Des remboursements qui peuvent, le cas échéant, incomber aux employeurs à l’égard des organismes de sécurité sociale et institutions sociales dans les conditions prévues à l’article L. 244-8 du code de la sécurité sociale.
