Article L1251-50 of the French Labour Code

The financial guarantee may only result from a guarantee undertaking given by a mutual guarantee company, a collective guarantee body, an insurance company, a bank or a financial institution authorised to give guarantees.

It is calculated as a percentage of the annual turnover of the company concerned.

It may not be less than a minimum set annually by decree, taking account of average wage trends.

La garantie financière ne peut résulter que d’un engagement de caution pris par une société de caution mutuelle, un organisme de garantie collective, une compagnie d’assurance, une banque ou un établissement financier habilité à donner caution.

Elle est calculée en pourcentage du chiffre d’affaires annuel de l’entreprise intéressée.

Elle ne peut être inférieure à un minimum fixé annuellement par décret, compte tenu de l’évolution moyenne des salaires.
