Article L1253-16 of the French Labour Code

The representative trade union organisations in the user undertaking or in the grouping may bring civil actions under the provisions of this chapter on behalf of the employees of the grouping.

They may bring these actions without having to prove that they have a mandate from the person concerned, provided that the latter has been notified and has not stated that he objects.

The employee may always intervene in proceedings brought by the union.

Les organisations syndicales représentatives dans l’entreprise utilisatrice ou dans le groupement peuvent exercer en justice les actions civiles nées en vertu des dispositions du présent chapitre en faveur des salariés du groupement.

Elles peuvent exercer ces actions sans avoir à justifier d’un mandat de l’intéressé pourvu que celui-ci ait été averti et n’ait pas déclaré s’y opposer.

Le salarié peut toujours intervenir à l’instance engagée par le syndicat.
