Article L1253-8 of the French Labour Code

The members of the grouping are jointly and severally liable for its debts to the employees and to the bodies responsible for compulsory contributions. By way of derogation, the articles of association of an employers’ group may, on the basis of objective criteria, lay down rules for the distribution of these debts between the members of the group, enforceable against creditors. They may also provide for specific liability arrangements for local authorities that are members of the grouping.

Les membres du groupement sont solidairement responsables de ses dettes à l’égard des salariés et des organismes créanciers de cotisations obligatoires. Par dérogation, les statuts des groupements d’employeurs peuvent prévoir, sur la base de critères objectifs, des règles de répartition de ces dettes entre les membres du groupement, opposables aux créanciers. Ils peuvent également prévoir des modalités de responsabilité spécifiques pour les collectivités territoriales membres du groupement.
