Article L1255-16 of the French Labour Code

The following is punishable by a fine of €3,750 if a client company:

1° Employs a ported employee outside the cases provided for in Article L. 1254-3 ;

2° Disregards the prohibitions on employing a ported employee provided for in Articles L. 1254-4 and L. 1254-5 ;

3° Failing to enter into a commercial contract with the freelance administration company for the provision of freelance administration services within the period specified in Article L. 1254-22 ;

4° Entering into a commercial contract with the freelance administration company for the provision of freelance administration services that does not include the information specified in Article L. 1254-23.

A repeat offence is punishable by six months’ imprisonment and a fine of €7,500.

Est puni de 3 750 € d’amende le fait pour une entreprise cliente :


1° De recourir à un salarié porté en dehors des cas prévus à l’article L. 1254-3 ;


2° De méconnaître les interdictions de recourir à un salarié porté prévues aux articles L. 1254-4 et L. 1254-5 ;


3° De ne pas conclure avec l’entreprise de portage salarial le contrat commercial de prestation de portage salarial dans le délai prévu à l’article L. 1254-22 ;


4° De conclure avec l’entreprise de portage salarial un contrat commercial de prestation de portage salarial ne comportant pas les mentions prévues à l’article L. 1254-23.


La récidive est punie de six mois d’emprisonnement et de 7 500 € d’amende.
