Article L1263-4 of the French Labour Code

If the employer fails to rectify the situation observed within the period referred to in article L. 1263-3, the competent administrative authority may, as soon as it is aware of a report by a Labour Inspectorate monitoring officer recording the breach and having regard to the repetition or seriousness of the facts observed, order, by reasoned decision, that the employer suspend the provision of the services concerned for a period not exceeding one month.

The administrative authority will put an end to the measure as soon as the employer can prove that the breach has ceased.

A défaut de régularisation par l’employeur de la situation constatée dans le délai mentionné à l’article L. 1263-3, l’autorité administrative compétente peut, dès lors qu’elle a connaissance d’un rapport d’un agent de contrôle de l’inspection du travail constatant le manquement et eu égard à la répétition ou à la gravité des faits constatés, ordonner, par décision motivée, la suspension par l’employeur de la réalisation de la prestation de services concernée pour une durée ne pouvant excéder un mois.


L’autorité administrative met fin à la mesure dès que l’employeur justifie de la cessation du manquement constaté.
