Article L1272-4-1 of the French Public Health Code

As stated in Article 511-5-1 of the Criminal Code, reproduced below:

Art. 511-5-1 -The taking of samples for scientific purposes from a deceased person without having submitted the protocol provided for in article L. 1232-3 of the Public Health Code is punishable by two years’ imprisonment and a fine of €30,000.

The same penalties apply to the implementation of a protocol that has been suspended or prohibited by the Minister responsible for research.

Comme il est dit à l’article 511-5-1 du code pénal ci-après reproduit :

Art. 511-5-1.-Le fait de procéder à des prélèvements à des fins scientifiques sur une personne décédée sans avoir transmis le protocole prévu à l’article L. 1232-3 du code de la santé publique est puni de deux ans d’emprisonnement et de 30 000 euros d’amende.

Est puni des mêmes peines le fait de mettre en œuvre un protocole suspendu ou interdit par le ministre chargé de la recherche.
