A performance contract is a contract by which the author of an intellectual work and his successors in title authorise a natural or legal person to perform the said work under conditions that they determine. A general performance contract is a contract by which a professional authors’ organisation grants an entertainment company or any other user the right to perform, for the duration of the contract, current or future works in the repertoire of the said organisation under conditions determined by the author or his successors in title.
In the case provided for in the previous paragraph, the provisions of article L. 131-1.
The general performance contract with an on-demand audiovisual media service within the meaning of Article 2 of Law No. 86-1067 of 30 September 1986 provides for the transmission of information on the number of acts of downloading, consultation, listening to or viewing of works, according to a periodicity adapted to the distribution of rights. This information may be communicated to each author in respect of his or her works by the collective management organisation of which he or she is a member.
