I. – Where the majority of the members of a consortium are local authorities or local public establishments other than a public social or medico-social establishment or a public housing office, a tendering committee is set up comprising the following members:
1° One representative elected from among the members with voting rights on the tendering committee of each member of the grouping that has a tendering committee;
2° One representative for each of the other members of the grouping appointed in accordance with the procedures specific to them.
The tender committee is chaired by the representative of the grouping coordinator. An alternate member may be appointed for each full member.
Ia. – Where the majority of the members of a consortium are public housing offices, a tendering committee shall be set up in accordance with the procedures laid down by decree in the Conseil d’Etat.
II. – The agreement establishing a grouping of orders may stipulate that the competent tendering committee is that of the coordinator of the grouping if the latter has one.
III. – The chairman of the committee may appoint persons with expertise in the subject matter of the consultation. These persons shall be invited to attend and may take part, in an advisory capacity, in the meetings of the tendering committee.
The tendering committee may also be assisted by staff from the members of the consortium who are competent in the matter which is the subject of the consultation or in public procurement matters.
The accounting officer of the grouping coordinator, if the latter is a public accounting officer, and a representative of the minister responsible for competition may attend meetings of the tendering committee in an advisory capacity, when invited to do so. Their comments are recorded in the minutes.
