The officials mentioned in article L. 1421-1 may collect, on the spot or when summoned, any information, justification or document necessary for the controls. They may demand to see, obtain or take copies of, by any means and on any medium, or seize documents of any kind, wherever they may be, to facilitate the performance of their duties and provide them with the resources they need to carry out their checks. For the control of computerised operations, they have access to software and stored data, as well as to the unencrypted reproduction of information likely to facilitate the performance of their duties. They may request that this information be transcribed by any appropriate process into documents that can be used directly for the purposes of the audit.
They may take samples. Samples are analysed by a State laboratory, by the Agence nationale de sécurité du médicament et des produits de santé or by a laboratory designated by the director general of the regional health agency or, when the control has been carried out on behalf of the Agence nationale de la sécurité du médicament et des produits de santé, the Agence de la biomédecine or the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail, by the director general of this agency.
Medical officers have access to all individual medical data necessary for the performance of their duties, in compliance with the provisions of article 226-13 of the French Penal Code.
Employees who are pharmacists shall have access to all individual medical data necessary for the performance of their duties relating to the practice of pharmacy and the products mentioned in article L. 5311-1 or those relating to the monitoring of the collection of quality and safety indicators, in compliance with article 226-13 of the French Criminal Code.
