Article L1424-20 of the French General Code of Local Authorities

For the drawing up of the agreements provided for in articles L1424-13, L1424-14 and L1424-17, either party may request the opinion of the departmental consultative commission provided for in Article L1424-21, on legal or financial matters.

In the event of a dispute over one or more provisions of the draft agreement referred to in article L1424-17, the two parties may jointly appoint an arbitrator whom they choose from a list of qualified persons drawn up by the president of the regional audit chamber in whose jurisdiction the departmental fire and rescue service is located. The two parties pay the arbitrator’s fees in equal shares and the arbitration decision is binding on both parties.

Pour l’élaboration des conventions prévues aux articles L1424-13, L1424-14 et L1424-17, chacune des parties peut demander l’avis de la commission consultative départementale prévue à l’article L1424-21, sur des questions juridiques ou financières.

En cas de différend sur une ou plusieurs dispositions du projet de convention mentionnée à l’article L1424-17, les deux parties peuvent désigner d’un commun accord un arbitre qu’elles choisissent sur une liste de personnes qualifiées, arrêtée par le président de la chambre régionale des comptes dans le ressort de laquelle se situe le service départemental d’incendie et de secours. Les deux parties prennent en charge, à parts égales, la rémunération de l’arbitre.L’arbitrage rendu lie les deux parties.
