Article L1424-3 of the French General Code of Local Authorities

The fire and rescue services are placed for employment under the authority of the mayor or the prefect, acting within the scope of their respective police powers.

To carry out the prevention missions for which they are responsible, in particular with regard to the regulations applicable to fire and panic risks in establishments open to the public, the mayor or the prefect has at its disposal the resources falling within the remit of the fire and rescue services.

The resources of the departmental or territorial fire and rescue service dedicated to prevention actions are defined by the board of directors taking into account the number of establishments in the department falling under the regulations applicable to fire and panic risks in establishments open to the public.

Les services d’incendie et de secours sont placés pour emploi sous l’autorité du maire ou du préfet, agissant dans le cadre de leurs pouvoirs respectifs de police.

Pour assurer les missions de prévention qui leur incombent, notamment en ce qui concerne la réglementation applicable aux risques d’incendie et de panique dans les établissements recevant du public, le maire ou le préfet dispose des moyens relevant des services d’incendie et de secours.

Les moyens du service départemental ou territorial d’incendie et de secours consacrés aux actions de prévention sont définis par le conseil d’administration en tenant compte du nombre des établissements dans le département relevant de la réglementation applicable aux risques d’incendie et de panique dans les établissements recevant du public.
