Article L1424-36-4 of the French General Code of Local Authorities

In local fire and rescue services, volunteer firefighters are recruited and managed by the commune or the public establishment for inter-communal cooperation.

By way of derogation from the first paragraph, volunteer fire brigade officers and non-commissioned officers may, under conditions laid down by regulation, be appointed to their ranks or duties jointly by the competent State authority and the mayor or president of the public establishment for inter-communal cooperation.

Dans les services locaux d’incendie et de secours, les sapeurs-pompiers volontaires sont engagés et gérés par la commune ou l’établissement public de coopération intercommunale.


Par dérogation au premier alinéa, les officiers et les sous-officiers de sapeurs-pompiers volontaires peuvent, dans des conditions fixées par voie réglementaire, être nommés dans leurs grades ou fonctions conjointement par l’autorité compétente de l’Etat et le maire ou le président de l’établissement public de coopération intercommunale.
