Article L1424-41 of the French General Code of Local Authorities

Staff transferred pursuant to article L1424-13 retain the benefits individually acquired on 1 January 1996 in terms of remuneration in their original local authority or establishment, if this system is more favourable to them.

They shall retain, under the same conditions, the benefits in the nature of additional remuneration that they have collectively acquired on the same date within their local authority or establishment through social organisations. These benefits are paid for by the local authority or establishment of origin.

Les personnels transférés en application de l’article L1424-13 conservent les avantages individuellement acquis au 1er janvier 1996 en matière de rémunération dans leur collectivité ou établissement d’origine, si ce régime leur est plus favorable.

Ils conservent dans les mêmes conditions les avantages ayant le caractère de complément de rémunération qu’ils ont collectivement acquis à la même date au sein de leur collectivité ou établissement par l’intermédiaire d’organismes à vocation sociale. Ces avantages sont pris en charge par la collectivité ou l’établissement d’origine.
