Article L1424-8 of the French General Code of Local Authorities

Without prejudice to the provisions of article L. 2216-2, the transfer of management competencies provided for by this chapter to the benefit of the departmental or territorial fire and rescue service entails the transfer of the civil liability of the communes or public establishments for inter-communal cooperation for damage resulting from the exercise of these competencies.

Sans préjudice des dispositions de l’article L. 2216-2, le transfert des compétences de gestion prévu par le présent chapitre au profit du service départemental ou territorial d’incendie et de secours emporte transfert de la responsabilité civile des communes ou des établissements publics de coopération intercommunale au titre des dommages résultant de l’exercice de ces compétences.
