Article L1424-88 of the French General Code of Local Authorities

The head of the fire and rescue service is appointed by order of the president of the territorial council with the assent of the representative of the State.

Under the authority of the representative of the State, he/she is responsible for:

1° The operational management of the fire brigade;

2° The management of prevention actions falling within the remit of the fire and rescue service.

To carry out these missions, he/she may receive a delegation of signature from the representative of the State.

Under the authority of the State representative or the president of the territorial council, as part of their respective police powers, he is also responsible for the operational implementation of all fire-fighting and rescue resources.

The head of the fire and rescue service may be assisted by a deputy who replaces him, in the event of absence or impediment, in all of his duties. This deputy is appointed under the same conditions as the head of the department and may also receive the delegations of signature mentioned in this article.

Le responsable du service d’incendie et de secours est nommé par arrêté du président du conseil territorial sur avis conforme du représentant de l’Etat.

Sous l’autorité du représentant de l’Etat, il assure :

1° La direction opérationnelle du corps des sapeurs-pompiers ;

2° La direction des actions de prévention relevant du service d’incendie et de secours.

Pour l’exercice de ces missions, il peut recevoir délégation de signature du représentant de l’Etat.

Sous l’autorité du représentant de l’Etat ou du président du conseil territorial, dans le cadre de leurs pouvoirs de police respectifs, il est également chargé de la mise en œuvre opérationnelle de l’ensemble des moyens de secours et de lutte contre l’incendie.

Le responsable du service d’incendie et de secours peut être assisté d’un adjoint qui le remplace, en cas d’absence ou d’empêchement, dans l’ensemble de ses fonctions. Cet adjoint est nommé dans les mêmes conditions que le responsable du service et peut également recevoir les délégations de signature mentionnées au présent article.
